PLEASE NOTE: NO RETURNS ARE ACCEPTABLE AFTER 30 DAYS. ALL RETURNS MUST HAVE AN RMA NUMBER ON THE BOX OR THE PACKAGE WILL BE REFUSED. CHANGES MAY HAPPEN WITHOUT NOTICE ON PRODUCT DIMENSIONS OR DESCRIPTIONS. FOR PRECISE INFORMATION PLEASE CALL US AT 800-838-5070 BEFORE YOUR PURCHASE.
1) SHIPPING POLICY INFORMATION, SHIPPING TIMES, ETC:
CLICK FOR UPS MAP: Standard shipping is usually 2 – 5 business days depending on your location. Items are being shipped from zip code 77477.
IMPORTANT: Please open and inspect your order within 7 business days after receiving. If you are installing product(s) at a later date, any damage, missing or wrong items must be claimed and called in by phone 800-838-5070 within 7 business days. All damaged or missing items claims must be received within 7 business days after you receive your order. We will not be held accountable for any lead times or job site restrictions. Product specifications are subject to change without notice.
2) RETURNS & EXCHANGES (DAMAGED, DEFECTIVE, AND UNWANTED ITEMS YOU WISH TO RETURN)
All sales are final. Any cancellation, returns or exchanges must be called in by phone at 800-838-5070. Any items that are received damaged in shipment must be reported within 7 business days of receipt. Non-defective items are exchanged or refunded and will be subject to a 20 – 45% restocking fee. We reserve the right to deny returns or exchanges of non-damaged or defective items within 30 days of the sale date. Returned items must be in new and unused condition in original packaging. Defective items will be exchanged or refunded (at our discretion) within the warranty period specified. Shipping charges WILL NOT BE REFUNDED on non defective returns, no exception. Shipping charges will be refunded on defective returns/ exchanges within the 30 days after customer receipt of the order. After 30 days, if your product is defective and within the warranty period we will repair or replace the product free of charge.
3) LIMITATION LIABILITY:
In no case will Dynamic Voice Data be liable for any bodily injury, death, or property damage resulting from or in any way arising out of the goods or their sale, use, or manufacture. DVD WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD-PARTY. DVD WILL NOT BE LIABLE FOR LOST OR CORRUPTED DATA OR SOFTWARE. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES, DVD CABLE ALSO KNOW AS DynaCable@ IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE UNDER THIS SALES AGREEMENT.
A) WARRANTY ON IN HOUSE PRODUCTS: Dynamic Voice Data will only refund or replace defective material within the warranty period. Dynamic Voice Data connectivity parts also known as DynaCable@ offers a lifetime performance warranty. This warranty only covers manufacture defect that is not caused by human error or wrong installation or abuse. DVD will not be responsible in any circumstances for any damage, loss of profit, labor needed, legal fees or any fees related.
B) WARRANTY ON THIRD PARTY PRODUCTS: Dynamic Voice Data will only offer the manufacturer’s warranty on third party items. Third party items are items sold by Dynamic Voice Data and are purchased through one of our suppliers or distributors.
Price shown or quoted does not include taxes applied to the products on the order. All local customers in the State of Texas and customers nationwide shipping to the State of Texas will be charged taxes unless a current Texas Resale Certificate is provided. Customer agrees to pay DVD any taxes charged if the Resale Certificate number was invalid or rejected.
5) DELAY IN DELIVERY:
ETA (Estimated Time of Arrival) for components coming on our containers or shipped to customers is not a guaranteed time of delivery. DVD will in no case be liable for any consequential delays to customer projects due to any delays in shipments. ETA provided is the best estimate provided by our suppliers and factory or shipper. ETA are provided to customers to our best knowledge and if any delays were to occur it would be out of DVD’s control and thus DVD will not be held accountable.
6) ADDITIONAL TERMS AND CONDITIONS OF SALE:
A.MINIMUM ORDER: Please note that we have a $30.00 minimum order (This is the order before any applicable taxes and shipping charges). If you choose to order items and the order is under $30.00, a surcharge will be applied. Any order that is under our $30.00 minimum that is accepted by our system will have a $5.00 surcharge added to the order.
B.ALASKA, HAWAII, CANADA, PUERTO RICO, ETC: It is recommended if you reside outside of the lower 48 states that you call in your order at 800-838-5070.
C.IMAGE QUALITY AND COLORS SHOWN ON OUR WEBSITE: Due to printing, scanning, reproduction process, your monitor quality, monitor settings, video card type & settings, etc; colors/finishes, lenses shown on our website and / or catalog will be very close but cannot be guaranteed to be an exact duplicate of the actual finish you receive. Unfortunately this is beyond our control.
D.PRODUCT SPECIFICATIONS, CHANGES TO SPECIFICATIONS, ETC: Although we are diligent and update product specifications as often as possible, product specifications such as but not limited to dimensions, minor product changes, etc. on occasion can and do happen. We are not responsible if these product changes differ from the website. If you need exact dimensions, specifications, etc., please CALL US at 800-838-5070 before placing your order and we can verify with you the current specifications so there are no surprises.
E.OTHER IMPORTANT INFORMATION AND TERMS: We cannot and will not advise on installation and wiring of as we are prohibited and held liable by law since we are NOT licensed electricians. We may, however, be able to assist you in locating qualified licensed electricians to suit your needs.
F.INFORMATION ON DISPUTES AND RESOLUTIONS: If there is an issue with your order (i.e. missing item(s) or damaged goods not reported within 48 hours, or you’re wanting to return part of or all of the order, etc.) and you dispute your credit card through your credit card company without following our Terms and Conditions, you will be subject to our collection agency to pursue our monies as well as all collection fees. If we do have to send the account to collections, there will be no negotiating at that point through us, it will all be through our collection agency. If you fail to pay the amount due in collections you will be subject to litigation, which may severely affect your credit score. Any credit card disputes that do not fall within our Terms & Conditions of Sale are subject to finance fees, collection fees every day they are past due until funds are collected, finance and interest fees are up to 7% per day starting from invoice date, or the maximum allowed by law. In the event the account is turned over for collection, Client agrees to pay any and all collection costs incurred to collect the unpaid balance(s) with the legally allowed interest and fines. Client waives right to jury trial and consents to the long arm jurisdiction of the court. Reasonable attorney’s fees shall be awarded the prevailing party.
